TERMS OF SERVICE

CUSTOMER SERVICE AGREEMENT

This Customer Service Agreement (“Agreement”) is entered into between Notary Performance and Background LLC (“Service Provider”) and the undersigned customer (“Customer”). This Agreement is intended to clarify services rendered, set expectations, and reduce disputes or chargebacks.

1. Services

Customer agrees to purchase professional services as requested, including but not limited to Remote Online Notarization (RON), mobile or in-person notary services, document preparation, background-related services, fingerprinting, or administrative services, as permitted by law.

2. Fees and Payment

All fees are disclosed to the Customer prior to service. Payment is due before or at the time services are rendered, unless otherwise agreed in writing.

3. Refund and Cancellation Policy (Card Network Compliant)

Customer acknowledges that services provided are professional services and not tangible goods. Due to the nature of these services, refunds are limited.

• If services have been fully rendered, no refund will be issued.

• If services have been initiated or scheduled, fees may be retained to cover time, administrative costs, and availability.

• Any approved refund is issued solely at the discretion of Service Provider and must be requested in writing.

This policy is disclosed prior to payment in accordance with card network rules.

4. Chargebacks and Payment Disputes (Processor Best Practices)

Customer agrees to contact Service Provider directly to resolve any billing questions or concerns prior to initiating a chargeback or payment dispute.

Chargebacks are intended for unauthorized or fraudulent transactions only. By completing payment, Customer confirms the transaction is authorized and agrees that filing an improper chargeback may constitute a breach of this Agreement.

In the event of a chargeback, Customer may be responsible for:

• The original service fee

• Any chargeback or processing fees assessed by the payment processor

• Reasonable administrative costs incurred by Service Provider

Service Provider reserves the right to submit this signed Agreement, invoices, receipts, timestamps, IP addresses, and proof of service to the payment processor as evidence.

5. Payment Authorization and Proof of Consent

Customer certifies that they are the authorized cardholder or account holder and authorize Service Provider to charge the payment method provided for the agreed-upon amount.

Customer agrees that this Agreement, along with electronic records, confirmations, and service logs, may be used as proof of consent in the event of a dispute.

6. Customer Responsibility & Remote Online Notary (RON) Technical Requirements

Customer is responsible for providing accurate information and required documents.

For Remote Online Notary (RON) services, Customer acknowledges they must have:

• A compatible, up-to-date device (computer, tablet, or smartphone)

• Ability to receive and open PDF documents and emails

• A stable and strong internet connection

• A functioning web camera

• Working speakers and/or microphone to clearly hear and communicate

Failure to meet these requirements may prevent completion of the notarization. Time spent attempting to resolve technical issues is considered services rendered and may be non-refundable.

7. Right to Refuse or Deny Service

Notary Performance and Background LLC reserves the right to refuse, deny, or discontinue services at any time, with or without notice, in compliance with applicable law. Reasons may include, but are not limited to:

• Inability to verify identity

• Failure to meet technical requirements

• Incomplete or inaccurate information

• Non-compliance with notarial laws

• Inappropriate or disruptive conduct

8. Limitation of Liability

Service Provider is not liable for indirect, incidental, or consequential damages. Liability, if any, is limited to the amount paid for the service.

9. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Florida.

10. Electronic Acceptance & Click-to-Accept Consent

By selecting the checkbox and submitting payment, Customer acknowledges and agrees that:

• They have read and understand this Agreement

• They agree to the Refund and Chargeback policies

• They authorize payment for services requested

• They understand services rendered or initiated are subject to limited or no refunds

This electronic acceptance constitutes a legally binding signature under the U.S. E-SIGN Act.
